If you have a question about this talk, please contact Shuai Eddie WEI. Abstract Positive list is the long practice used by China to regulate foreign investment. Specifically, the central government has guided the foreign investment by promulgating the catalogue of industries which are open, restricted or forbidden to foreign investment. This practice has been changed first in those free trade zones by the adoption of the negative list, and will be reversed eventually in 2018 according to the decision made by the State Council. This change is not only the focus of the on-going Sino-American BIT negotiations, but also the centerpiece of the newly-made Foreign Investment Law.
