DESCRIPTION:Building on constructivist theories concerning nat
 ional identity formation as well as institutionali
 st theories regarding the regulatory power of law

 hts laws protecting religious freedom ‘subject to’
  politically shifting claims regarding public orde
 r)\, this paper examines a pattern of ‘religious’ 
 national identity formation in Muslim-majority Pak
 istan and Malaysia. Specifically\, it illuminates 
 a pattern of intra-religious boundary-formation gr
 ounded in what I call fundamental-rights lawfare—a
  pattern in which majoritarian political actors ur
 ge senior judges to operationalize existing religi
 ous-freedom provisions in ways that help to ‘secur
 itize’ certain self-identifying co-religionists as
  provocative ‘heretics’ who\, posing a risk to ‘pu
 blic order’\, lie outside the boundaries of each c
 ountry’s majoritarian constitutional community.
